ABOUT TERMS & CONDITIONS
Under these Terms and Conditions, "we", "us" and "Homes N Things" mean Homes N Things Pty Ltd (ABN 53 610 882 196) and "you" means you the customer. HOMESNTHINGS.COM.AU is the trading website of Homes N Things Pty Ltd (ABN 53 610 882 196).
Please read the terms & conditions carefully before using this site. Access to and use of this site are subject to the following Terms and Conditions and cannot be varied unless a prior agreement has been made by us in writing or email.
Visitors to this website shall assume all responsibility and risk for the access and use of this website. All information published on this website is provided to visitors for informational purposes only. No information provided on this website constitutes an endorsement or recommendation of any item, product or brand. Although all reasonable care has been taken with regard to the content of the website, Homes N Things does not warrant or represent that access to and use of this site or the server which makes it available and including any emails sent from us, will be uninterrupted, error-free and free of components including malware or viruses which are harmful to your computer. The contents of this site may include errors for which Homes N Things assumes no responsibility.
You are required to provide us with personal identification and other details which are correct and current. You acknowledge that you are eighteen (18) years or over. If you are under the age of eighteen (18) years you are not permitted to purchase or place an order from the HOMESNTHINGS.COM.AU website. You acknowledge that the credit card details you provide us with are true, correct and current.
We only sell and ship our products within Australia. We will not make deliveries outside of Australia.
For orders below $200, we currently only accept Visa and Master Card for credit card payments, or Paypal. For orders above $200, we only accept payments through Paypal.
Although we make every effort to provide accurate colours for products listed on our website, we cannot guarantee that the colour(s) viewed on your monitor(s) will be an exact match to the actual colour(s) of the product(s) delivered. Any description of our product including any images, dimensions and weights, are only approximate and is given for the sole purpose of identification.
Faulty ,damaged or incorrectly supplied products
When you receive delivery of our products, please inspect your goods immediately. If any of the products are damaged or incorrectly supplied, you have up to 30 days after the delivery date to notify us and upon return of the product(s), you are entitled to a choice of either a refund, or an exchange with an equivalent product provided that the product is in stock. Please keep all packaging and manuals supplied with the product in good, original condition. All items, faulty, damaged or non-damaged, must be returned with its proof of purchase, original packaging and manuals, in its original condition. We reserve the right to inspect all returned items, and to charge a $50 handling and administration fee if the condition of the product was found to be misrepresented by the customer.
How to claim for a refund
To make a refund claim for damaged goods, you must first notify our staff using our contact form indicating which product(s) are damaged or incorrectly supplied, along with your contact details and purchase order number. Our staff will then contact you with further instructions on how to complete your refund claim.
For non-damaged goods
We may accept returns at our own discretion where the order was supplied correctly and in good order. Please contact us before completing your purchase if you have any questions regarding the products you wish to purchase, as we may refuse to accept return of the product(s) purchased where the item was supplied correctly & in good order but the customer have changed their mind.
If your request for a return is accepted, the products approved for return must include all original packaging, and must be received in good condition within 14 days from the date the return request was approved. All shipping charges associated with the return of the item must be paid for by the customer, and a 10% restocking fee based on the total value of the products returned, will be deducted from the refund. If in such case a return is accepted and an exchange is requested, you will also need to pay for the delivery fee associated with dispatching the exchange item. You agree that you shall make no claim against us for any delay in delivery or any damaged product delivered to you as a direct or indirect result of events beyond our control. Homes N Things will not provide a refund or replace a product that has been misused, mishandled or incorrectly installed or serviced. It is the responsibility of the customer to read and follow all instructions and advice or warnings given by the manufacturer or supplier.
Please note that due to hygiene reasons, we will not accept the return of bedding products where the customer has changed their mind.
PRICING & GST
We may change our product and prices at any time without prior notice. The cost of delivering our product to you is in addition to the price of our product and must be paid at the same time you pay for our product in full. All purchases made from HOMESNTHINGS.COM.AU include GST.
ORDER AND ACCOUNT CANCELLATION
We reserve the right to terminate an account or cancel an order at any time for any reason. In the case of cancelling an order, Homes N Things will refund the purchase amount in full.
LIMITATION OF LIABILITY
By accepting these Terms and Conditions you agree and acknowledge that Homes N Things is not responsible for any interruptions, errors, infections, delay in operation or transmission, line failure, omissions, defects, damage to or loss of any equipment, programs, data or other information stored on any media arising out of your use of this site or with respect to the material provided and/or contained on this site.
Whilst Homes N Things employs Secure Sockets Layer (SSL) technology software for its transactions with our customers, Homes N Things will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.
In no event shall we be liable for direct, indirect or consequential damages, including but not limited to loss of use, loss of income, loss of profit, or loss of data, resulting from an action under theories of contract, negligence, strict liability, or otherwise, arising from the use of or inability to use the information or materials on the Homes N Things website.
Under no circumstances shall Homes N Things’s total liability to you for any and all claims, damages, losses, and causes of action exceed the amounts paid to Homes N Things by you in connection with the transaction claimed by you to give rise to your claim.
All personal data such as name, e-mail address, physical address, telephone number and payment information transmitted over the internet due to placing an order, logging in or registering an account, shall be treated as confidential information. Any communication or other materials which you submit to Homes N Things or to HOMESNTHINGS.COM.AU relating to products, experiences, suggestions or other subject matter via email, products reviews or other postings, will be treated as non-confidential and non-proprietary submissions.
By placing your order, you agree that we may store, process and use data collected from your Account/Order form for the purposes of processing your order. At Homes N Things, we will not share your personal information with any other party for any purpose other than to process your order, and unless required or authorised by law.
When you visit our site, short text files called cookies are downloaded to your computer. These cookies are used to store small amounts of information. This information is collected for remembering your shopping cart, traffic analysis and marketing.
homesnthings.com.au may use the available information from the cookies to advertise to you on other websites that are part of the Google Display Network. This is called remarketing.
