Under these Terms and Conditions, "we" and "us" mean Superhomes ABN 55 405 515 491 and "you" means you the customer. Homes N Things is the trading name of Superhomes ABN 55 405 515 491 and HOMESNTHINGS.COM.AU is the trading website of Superhomes.

Please read the terms & conditions carefully before using this site. Access to and use of this site are subject to the following Terms and Conditions and cannot be varied unless a prior agreement has been made by us in writing or email.

Visitors to this website shall assume all responsibility and risk for the access and use of this website. All information published on this website is provided to visitors for informational purposes only. No information provided on this website constitutes an endorsement or recommendation of any item, product or brand. Although all reasonable care has been taken with regard to the content of the website, Superhomes does not warrant or represent that access to and use of this site or the server which makes it available will be uninterrupted, error-free and free of components which are harmful to your computer. The contents of this site may include errors for which Superhomes assumes no responsibility.

YOUR DETAILS

You are required to provide us with personal identification and other details which are correct and current. You acknowledge that you are eighteen (18) years or over. If you are under the age of eighteen (18) years you are not permitted to purchase or place an order from the HOMESNTHINGS.COM.AU website. You acknowledge that the credit card details you provide us with are true, correct and current.

PURCHASE

We only sell and ship our products within Australia. We will not make deliveries outside of Australia.

PAYMENT METHODS

We currently accept Visa, Master Card and American Express payments for credit card payments. We also accept payments through the Paypal service. All transactions including the purchase of goods from the HOMESNTHINGS.COM.AU website are strictly in terms of Australian Dollars only.

PRODUCT ACCURACY

Although we make every effort to provide accurate colours for products listed on our website, we cannot guarantee that the colour(s) viewed on your monitor(s) will be an exact match to the actual colour(s) of the product(s) delivered. Any description of our product including any images, dimensions and weights, are only approximate and is given for the sole purpose of identification.

RETURN POLICY

When you receive delivery of our products, you must inspect it immediately. If our product is damaged or incorrectly supplied, you must notify us immediately within 7 days of delivery and we will replace it with an equivalent product or refund your purchase at our option.

We will also accept returns at our own discretion if the order was supplied correctly and in good order, but only if your proof of purchase is returned and the products and its packaging are returned to us in its original condition within 7 days of delivery. However, you must pay all shipping charges for the return of the item and we will charge a restocking fee of 10% for all products returned. You agree that you shall make no claim against us for any delay in delivery or any damaged product delivered to you as a direct or indirect result of events beyond our control.

Superhomes will not provide a refund or replace a product that has been misused, mishandled or incorrectly installed or serviced. It is the responsibility of the customer to read and follow all instructions and advice or warnings given by the manufacturer or supplier.

PRICING & GST

We may change our product and prices at any time without prior notice. The cost of delivering our product to you is in addition to the price of our product and must be paid at the same time you pay for our product in full. Please note that ALL prices listed on the HOMESNTHINGS.COM.AU website are strictly in Australian Dollars only and GST inclusive.

ORDER AND ACCOUNT CANCELLATION

We reserve the right to terminate an account or cancel an order at any time for any reason. In the case of cancelling an order, Superhomes will refund the purchase amount in full.

PRIVACY POLICY

All personal data such as name, e-mail address, physical address, telephone number and payment information transmitted over the internet due to placing an order, logging in or registering an account, , shall be treated as confidential information. Any communication or other materials which you submit to Superhomes or to HOMESNTHINGS.COM.AU relating to products, experiences, suggestions or other subject matter via email, products reviews or other postings, will be treated as non-confidential and non-proprietary submissions.

By placing your order, you agree that we may store, process and use data collected from your Account/Order form for the purposes of processing your order. At Homes N Things, we will not share your personal information with any other party for any purpose other than to process your order, and unless required or authorised by law.

SECURITY
To protect the privacy of your personal information, all personal data and credit card information are transmitted using a minimum 128-bit SSL (Secure Sockets Layer) encryption. All secured pages can be identified by the visible padlock icon located on your browser. Superhomes also uses ANZ's secure payments system to process credit card payments via the EFTPOS system. LIMITATION OF LIABILITY

By accepting these Terms and Conditions you agree and acknowledge that Superhomes is not responsible for any interruptions, errors, infections, delay in operation or transmission, line failure, omissions, defects, damage to or loss of any programs, data or other information stored on any media arising out of your use of this site or with respect to the material provided and/or contained on this site.

Whilst Superhomes employs Secure Sockets Layer (SSL) technology software for its transactions with our customers, Superhomes will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.
In no event shall we be liable for direct, indirect or consequential damages, including but not limited to loss of use, loss of income, loss of profit, or loss of data, resulting from an action under theories of contract, negligence, strict liability, or otherwise, arising from the use of or inability to use the information or materials on the Superhomes website.

Under no circumstances shall Superhomes's total liability to you for any and all claims, damages, losses, and causes of action exceed the amounts paid to Superhomes by you in connection with the transaction claimed by you to give rise to your claim.
